1. Acceptance of Terms

By accessing or using the PixieDine website (www.pixiedine.com) and services, including our SMS/text messaging program, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not use our services.

2. Description of Service

PixieDine is a dining reservation monitoring and alert service. We monitor publicly available Disney World dining reservation availability and notify you via text message and/or email when reservations matching your criteria become available. PixieDine is not affiliated with, endorsed by, or sponsored by The Walt Disney Company or any of its subsidiaries.

3. SMS/Text Messaging Terms

By opting in to PixieDine's text messaging program, you agree to the following:

  • You consent to receive automated text messages from PixieDine at the mobile phone number you provide. These messages will contain dining reservation availability alerts and may include embedded links to Disney's reservation system.
  • Message frequency varies. The number of messages you receive depends on the number of alerts you have configured and restaurant availability. You may receive multiple messages per day.
  • Message and data rates may apply. You are responsible for any message and data charges that may be applied by your mobile carrier. Check with your carrier for details.
  • Opt-out: You may opt out at any time by replying STOP to any text message from PixieDine. You will receive a one-time confirmation message and will no longer receive text messages unless you re-subscribe.
  • Help: Reply HELP to any text message for assistance, or contact us at support@pixiedine.com.
  • Consent to receive text messages is not a condition of purchase. You may use PixieDine's email-only alert service without opting in to text messages.
  • Supported carriers include but are not limited to AT&T, T-Mobile, Verizon, and Sprint. Service may not be available on all carriers.

4. Eligibility

You must be at least 18 years of age to use PixieDine's services. By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these terms.

5. Account Registration

To use certain features of PixieDine, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

6. Subscriptions and Payments

PixieDine offers free and paid subscription plans. Paid plans are billed on a monthly or annual basis as selected at the time of purchase. You may cancel your subscription at any time; cancellation will take effect at the end of your current billing period. Refunds are not provided for partial billing periods.

7. No Guarantee of Reservations

PixieDine monitors dining reservation availability and notifies you of openings. We do not guarantee that you will be able to book any reservation.Availability is subject to Disney's reservation system, and reservations may be claimed by other users before you are able to complete a booking. PixieDine does not book reservations on your behalf.

8. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose.
  • Interfere with or disrupt the operation of our services.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Use automated tools, bots, or scrapers to interact with our services beyond their intended use.
  • Resell, redistribute, or commercially exploit our services without our written consent.

9. Intellectual Property

All content, features, and functionality of PixieDine, including but not limited to text, graphics, logos, and software, are the property of PixieDine and are protected by applicable intellectual property laws. Disney-related trademarks and names are the property of The Walt Disney Company and are used here for identification purposes only.

10. Disclaimer of Warranties

PixieDine is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or that alerts will be delivered within any specific timeframe.

11. Limitation of Liability

To the fullest extent permitted by law, PixieDine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of our services, whether based on warranty, contract, tort, or any other legal theory.

12. Privacy

Your use of PixieDine is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information, including your mobile phone number.

13. Changes to Terms

We reserve the right to modify these Terms & Conditions at any time. We will notify you of material changes by posting the updated terms on this page with a revised "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the updated terms.

14. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
